Is there a setting that forces it to not display the last uploaded photo?  I don't know why but people aren't easily grasping that they can click the tiny x and be able to upload a new photo. And ... it looks kind of crummy.

Why don't you consider change the workflow and delete it for them when they toggle the switch to Yes? I'm not saying I know how to do it without investigating, but it is the usability path I would explore.
